Terms of Service

01 The agreement

These terms are an agreement between you and [legal company name: to be filled in] (“we”, “us”), which runs BuildYourQR at buildyourqr.com. By creating an account or using the service you agree to them. If you’re using BuildYourQR for a business, you’re agreeing on its behalf and confirming you’re allowed to.

02 What BuildYourQR does

BuildYourQR lets you create QR codes that point to a short link we host, and choose (and change) where that link forwards: a web page, a contact card we host for you, or an augmented-reality viewer. We also show you statistics about how your codes are scanned. How we handle the data involved is described in our Privacy Policy.

03 Your account

• You must be at least 16 and give us accurate details, including an email address you can receive mail at.
• Keep your password to yourself. You’re responsible for what happens under your account; tell us straight away at hello@buildyourqr.com if you think someone else has access.
• One person or organisation per account. Don’t create accounts to get around plan limits.

04 Plans, payment and cancelling

• Free includes up to five dynamic codes (links and contact cards) and seven days of analytics history.
• Dynamic ($9 per month) and Pro ($19 per month, which adds AR ads) are paid monthly in advance. Current features and prices are on the pricing page.
• Payments are processed by Polar, our payment provider and merchant of record, which also calculates and collects any sales tax or VAT. Polar’s terms apply to the payment itself.
• Subscriptions renew each month until cancelled. You can cancel any time from the billing portal linked in your dashboard; you keep your paid features until the end of the period you’ve paid for.
• Upgrades apply immediately and are charged pro rata. Downgrades also apply immediately, with the difference settled on your next bill.
• If we change the price of your plan, we’ll email you before the new price applies to your next renewal, so you can cancel first if you don’t agree.
• If a charge looks wrong, email hello@buildyourqr.com and we’ll look into it.

After a plan ends, your codes keep working on the Free plan, including codes above the Free limit. You can’t create new codes beyond the Free limit, add new logos or create new AR ads until you upgrade again.

05 What your codes may link to

You’re responsible for where your codes point and what your contact cards and uploads contain. Don’t use BuildYourQR for:

• phishing, scams, fake login or payment pages, or anything designed to trick people;
• malware, or links that download or install software without clear warning;
• anything illegal where you or the people scanning are, including content that infringes someone else’s copyright or trademarks;
• sexual content involving minors, content that promotes violence or harassment, or content that exposes someone’s private information without consent;
• spam, or attempts to overload, probe or get around the security of our systems.

Because a code can be changed after it’s printed, people trust that it goes somewhere legitimate. If we find, or are told about, a code that breaks these rules, we may pause it, point it at a warning page, remove content, or suspend the account, where possible after contacting you. To report a code, email hello@buildyourqr.com with its short link.

06 Your content

Everything you upload or enter stays yours. You give us permission to store, process and display it only as needed to run the service, for example showing your contact card to people who scan it, or playing your video in the AR viewer. You confirm you have the right to use what you upload, including photos of other people.

07 Our service and brand

The BuildYourQR software, website and brand belong to us. You may use the QR code images you download from your account in any materials you like, for as long as you want.

08 Availability and changes

We work hard to keep short links and pages running, because we know your codes are printed. But the service is provided “as is”, and we can’t promise it will be uninterrupted or error-free. We may change or improve features over time.

If we ever decide to shut BuildYourQR down, we’ll give account holders reasonable advance notice by email, so you have time to replace printed codes.

09 Ending the agreement

You can stop using BuildYourQR and ask us to delete your account at any time by emailing hello@buildyourqr.com. We may suspend or close accounts that seriously or repeatedly break these terms, or where the law requires it. Where we can, we’ll tell you first and explain why.

10 Liability

To the extent the law allows, we aren’t liable for indirect or consequential losses (such as lost profits, lost business, or the cost of reprinting), and our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim arose.

Nothing in these terms limits liability that can’t be limited by law, or any rights you have as a consumer that can’t be waived.

11 Governing law

These terms are governed by the laws of [country: to be filled in], and disputes will be handled by its courts, unless the law where you live as a consumer gives you the right to bring a claim there.

12 Changes to these terms

We may update these terms. If a change matters, we’ll email account holders at least 14 days before it takes effect. Continuing to use BuildYourQR after that means you accept the new terms. Questions? Email hello@buildyourqr.com.
